This section explains the services you get from Curai Health. It tells you what to expect and what rules to follow.
When you click "I Accept" or use our Services, you agree to these Terms. If you do not agree, you may not use our Services.

Important Notices
1. What Services Do We Offer?
We offer two main types of services:
(1) Care Team Services β You can get health information and support from our care team. This includes clinical helpers, health coaches, and medical assistants. These team members are not licensed doctors or nurses.
(2) Telemedicine Visits β You can see licensed doctors, nurse practitioners, or physician assistants online.
Together, we call these "Care Services." The people who provide them are called "Providers." These services are for health questions that are not emergencies.

The Curai Health Assistant (AI Helper)
We also have a tool called the Curai Health Assistant. It uses AI (artificial intelligence) to chat with you. It helps your Provider learn about your needs quickly.
AI is a new and growing area of technology. The Curai Health Assistant may sometimes give wrong answers. Your Provider always checks what the AI tells you. The AI does not diagnose you or treat you. It does not replace your doctor. Always talk to a real doctor if you have health questions.

How We Use AI
Curai Health uses AI tools to help deliver your care. Here is what you should know:
Some features have extra rules. We will show you those rules when you use that feature. By using it, you agree to those extra rules. If you do not agree, you cannot use that feature.

2. Privacy
Our Privacy Policy explains how we collect, use, and share your information. Please read it carefully.

3. Who Can Use Our Services?
To use our Services, you must:
If you are signing up on behalf of someone else, you promise you have their permission.

4. Your Account
You are in charge of keeping your account safe. Use a strong password. Do not share it. If you think someone else has your password, change it right away. You are responsible for everything that happens on your account.
You need a working email to create an account. Update your email if it changes. When you create an account, you agree to get messages from us. These may include billing info, password changes, and other updates. You can unsubscribe from promotional emails at any time.

5. Care Services and Payment
Call 911 if you have a medical emergency. Do not use our Services for emergencies.
Care is given remotely, not in person. Your Provider decides what care you get. We do not promise you will receive a specific diagnosis, treatment, or prescription.

Health Education and Care Coordination
Some care team members are not licensed health professionals. They may work outside the U.S. English may not be their first language. They cannot diagnose you or replace your doctor. They are here to give you support and help you reach your health goals.

Telemedicine Visits
Licensed providers see patients online. Not every health issue can be treated by telemedicine. Your provider decides if a telehealth visit is right for you. Telemedicine is not available in every state or at all times.
Please read our Telehealth Informed Consent. It explains the risks and benefits. By agreeing to these Terms, you also agree to the Telehealth Consent.
You must be in the state you select when you use Care Services. If you lie about your location, you may have to pay for any problems that result.

Payment
When you give us a payment method, you allow us to charge it for services plus any taxes. If your payment fails and you do not fix it, you still owe the amount.

AUTO-RENEWAL POLICY: Monthly plans renew every month until you cancel. To cancel: go to Account Settings or email support@curai.com. Free trials: One per household. Billing starts when your trial ends. We will NOT send you a reminder before billing starts. Refunds: If you had no visits during a billing period, email support@curai.com within 30 days for a refund.
Prices for consultations may go up at any time. We collect sales tax when required.

6. Our Rights
We can change, pause, or stop any part of our Services at any time. We can also limit or stop your access if needed. We may look into misuse and work with law enforcement if required.

7. Ownership
All content on our platform β like text, images, and videos β belongs to Curai Health. You can use it for personal use only. You may not:
If you give us feedback or suggestions, we can use them without paying you.

8. Content You Share
You own the content you share with Providers (messages, photos, etc.). By sharing it, you give us permission to use it to run our Services. You are responsible for any content you submit.

9. Using Our Services the Right Way
You must follow all laws when using our Services. Do not harm others or misuse the platform.

Our Services may have links to other websites. We do not control those sites. We are not responsible for them. Read their rules before you share any personal information.

11. Release
To the extent allowed by law, you agree that Curai Health is not responsible for disputes, claims, or damages you may have. This includes issues you know about and those you do not. California residents give up certain rights under California Civil Code Section 1542.

12. Indemnification
You agree to cover Curai Health for any problems caused by:

13. No Promises About Our Services
Our Services are provided "as is." We do not promise they will always work perfectly. We do not promise they will meet all your needs. You use our Services at your own risk. The Services are not for diagnosing or treating health problems.

14. Limits on What We Owe You
Curai Health is not responsible for losses you suffer from using our Services. This includes money, data, or anything else. The most we will pay you is $100 or the amount you paid us in the prior month, whichever is more.

15. Ending This Agreement
Either you or Curai Health can end this agreement at any time. If it ends, you will not get a refund. Curai Health will still give you access to your health records as required by law.

16. Solving Disagreements
Please read this section carefully. Most disagreements must be solved through arbitration. You cannot sue us in regular court or join a class action lawsuit.
Arbitration is a way to solve problems without going to court. A neutral person called an arbitrator listens to both sides. They then make a final decision. Both sides must accept it.

16.1 Binding Arbitration
If you have a problem with Curai Health, you cannot take it to regular court. Instead, you must use arbitration. You also cannot have a jury trial. The only exceptions are small claims court and cases to protect your ideas or inventions.

16.2 No Group Lawsuits
You must solve disputes on your own. You cannot join a class action or group lawsuit against Curai Health.

16.4 How to Start the Process
If you have a problem, write to us within 30 days. We will try to solve it together first. Send your letter by certified mail to:

Your letter must include: (a) your name, address, phone, and account email, (b) a description of the problem, and (c) what you want to happen.
If we cannot agree within 30 days, either side can start arbitration.

16.5 Arbitration Details
Arbitration takes place in Santa Clara County, California, in your county, or by phone. One arbitrator handles the case in private. The rules come from the American Arbitration Association (AAA). Each side pays its own costs.

16.8 Opt-Out
You can choose not to use arbitration. You must do this within 30 days of agreeing to these Terms. Write to the address above. Include your full name and say you want to opt out of arbitration.

17. Time Limit
You must file any claim within one year of when the problem happened. After one year, you lose the right to make a claim.

18. Laws and Courts
California law governs these Terms. If you cannot use arbitration or small claims court, your case will be heard in Santa Clara County, California.

19. Users Outside the U.S.
If you use our Services from outside the U.S., your information will be sent to and processed in the U.S. U.S. laws may not protect your privacy the same way as your home country's laws.

20. Changes to These Terms
We may update these Terms at any time. If you keep using our Services after a change, you agree to the new Terms. We will post updates on our website and may email you.

21. Apple Device Rules
If you use our app on an Apple device, Apple's App Store rules also apply. Apple is not responsible for our app or your care. You also promise you are not in a country under a U.S. embargo.

25. AI Translation
We use software to translate our Services into other languages. These translations may not be perfect. If there is a difference between a translation and the English version, the English version is the official one. Free interpreter services are available. Email us at support@curai.com to request one.

26. Recordings and AI Transcription
By using Curai Health, you agree that visits may be recorded. AI tools may turn the audio into text. This helps us create your medical records and check the quality of care. We use secure tools that follow HIPAA rules.

A Note About Your Health Information
If you use our Services as a patient, we protect your health information under a law called HIPAA. We call this your "Protected Health Information" or PHI. PHI includes your name, address, medical history, and notes from your doctor visits. If you connect a health app or fitness tracker to our Services, we may collect that data too.
This Privacy Policy does not cover how we use your PHI. That is covered by our HIPAA Notice of Privacy Practices.

AI and Your Information: Your health information may be used by AI tools. These tools help your care team respond to you. Other companies that run these AI tools cannot use your data for their own purposes. They cannot use it to train or build their own AI tools. They must keep your data safe. How We Share Your Information
We do not sell your personal information. We may share it with:
Third-Party Analytics
We use tools like Google Analytics to learn how people use our Services. These tools may use cookies and web beacons on our website.

"Do Not Track" Signals
Your browser may send a "Do Not Track" signal to websites. Our website does not change how it works when it gets this signal. We may still collect some information about your visit.

How Long We Keep Your Information
We keep your information for as long as needed. Here are the time frames:

We use strong tools to protect your information. But no security system is perfect. We cannot promise complete safety. Be careful about what you send by email.

Third-Party Websites
Our Services may link to other websites. We do not control those sites. Read their privacy policies before sharing your information.

Your Choices
You can review, fix, or ask us to delete your information. Email us at support@curaihealth.com. We may not be able to delete all health records, but we can deactivate your account.
California Residents: You have the right to: know what data we collect; delete or correct it; opt out of the sale or sharing of your data; limit how we use sensitive data; and not be treated unfairly for using your rights. We do not sell your personal information. You also have the right to know about AI tools that make important decisions about you.
Washington State β Your Health Data: The Washington My Health My Data Act gives you rights. You can confirm if we collect your health data. You can access it. You can withdraw your consent. You can ask us to delete it. We will not collect or share your health data without your consent first. A full notice for Washington residents is on our website and in the app.
People in Colorado, Oregon, Texas, Utah, Virginia, and Connecticut have similar rights. These rights come from their state laws. Contact us using the info below to use your rights.

Children's Privacy
Our Services are not for children under 13. We do not collect data from children under 13 on purpose. If you think a child under 13 gave us information, email privacy@curaihealth.com.
If you are under 18 and live in California, you can ask us to delete things you posted. Email privacy@curaihealth.com.

I. Who We Are
"We" means the different Curai Health Medical Group companies in: Florida, Illinois, New York, North Carolina, Texas, Georgia, and New Jersey. All of these companies follow the same privacy rules.
II. Our Duty to Protect Your Information
We must keep your health information private. We only use or share it when the law allows. We follow the rules in this Notice. We will not share your information for other reasons without your written permission.

III. Information We Collect
For your telehealth visits, we may collect and create:
Important β AI and Your Medical Record: AI tools may help draft your visit notes and create a visit summary. But a licensed clinician always reviews and signs the final notes. AI output alone is never used as your official record.
IV. When We Can Share Your Information Without Your Permission
We can use or share your health information without asking you first in these cases:
Reproductive Healthcare Protection: We will not share your health information about reproductive care. We will not use it to investigate anyone for seeking, getting, or helping with lawful reproductive care. This applies whether the care happened in your state or another state.

We need your written permission before using your health information for marketing. We will not take money from companies to promote treatments or services to you without your okay.

We will never sell your health information.

You can take back your permission at any time. Write to our Privacy Office. If we already acted on your permission, we cannot undo that.

VI. Your Rights
To use any of these rights, contact our Privacy Office. You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. We will never punish you for filing a complaint.

VII. How AI Is Used in Your Care Records
These AI tools are used during your telehealth visits as part of normal health care work:
A licensed clinician always reviews and approves these items before they go in your record. AI output alone is never your final medical record.

VIII. When This Notice Takes Effect
This Notice took effect on June 5, 2026. We can update it at any time. We will post the new Notice on our website at www.curaihealth.com.

4. Accuracy of Information
You are responsible for making sure the information you share is correct and up to date. Your provider will use this information to help you.

5. Release and Waiver
You agree to limit Curai Health's responsibility for any issues related to the use of telehealth technology.

6. Costs
You may have to pay fees for telehealth visits. You may also need to pay for medicines or supplies your doctor orders.

7. Other Legal Terms
This Consent can only be changed in writing with your agreement. If any part of it is found to be invalid, the rest still applies.

8. Your Right to Cancel
You can stop using telehealth at any time. This will not affect your right to get in-person care. To cancel, email support.curaihealth.com with your name and address. Your cancellation takes effect when we receive it.

North Carolina β This consent is your written consent to receive telehealth services.
AI Disclosure
California (Bus. & Prof. Code Β§ 2060): This platform may use AI to help with your care. A licensed provider is always available. To speak with one, request a visit in the app or email support@curaihealth.com.
Texas (Bus. & Com. Code Ch. 547): Curai Health uses AI tools to assist licensed providers. AI does not replace your provider's judgment. You can ask about AI's role in your care at any time.

1. Consent to Use and Share Your Health Information
You give Curai Health and its contracted partners permission to use and share your health information. This includes sensitive health information. They can do this for your treatment, payment, and health care needs as allowed by law.
Curai Health can share your information with your main doctor or your health plan. They can also share it with your employer for a workers' compensation claim.

2. Consent to Share HIV/AIDS Information
You give Curai Health permission to share your HIV/AIDS-related information with companies that help provide our Services. These companies must keep your information safe. They can also share it with your health plan for billing.
You can take back this permission at any time. It will end on its own when you stop using the app.

A Health Information Exchange (HIE) is a system that lets your doctors share your health records with other doctors. This helps them give you better care. Curai Health uses three HIE services:
If You Join (Opt In)
Curai Health and your doctors can get and share your health records with other doctors outside Curai Health who are part of these HIEs. You can change your mind at any time in your Curai Health Account Settings.

If You Do Not Join (Opt Out)
Curai Health will not share your records through these HIEs. Your care will not be affected. Your doctors can still get your records by fax, phone, email, or mail. In some cases β like public health emergencies β your records may still be shared as required by law.

What May Be Shared
Sensitive Information: Some records get extra protection. These include: substance use disorder records; HIV/AIDS information; mental health records; genetic information; and reproductive health information. These records are only shared with your written permission when the law requires it.

If your child is under 18, you must give permission for their medical care. This consent form lets Curai Health treat your minor child through telehealth.

I know there are risks and benefits to telehealth care. I will keep my child's login safe and be present for any medical visits.
I know there is no guarantee the treatment will work. My child's doctor will explain other options if there are any. The doctor decides if telehealth is right for my child.
I can ask questions about my child's care. I confirm that I am my child's parent or legal guardian. I have the right to make medical decisions for my child. No court order prevents me from doing so.

Who Qualifies
This form is for minors who are 13 or older. Curai Health does not treat children under 13. If a child under 13 has accessed our Services, email privacy@curai.com.

How We Verify Your Identity
Before treating your child, we will confirm who you are using one of these methods:

I know that Curai Health also needs my parent or guardian to agree to my care. I give Curai Health permission to contact my parent or guardian to get their consent. I agree that Curai Health can share my medical records with my parent or guardian. I also agree that my records may be shared with my health plan for billing.
